Alternative Dispute Resolution (ADR): Alternative Dispute Resolution (ADR) refers to a set of methods and processes employed to resolve conflicts and disputes outside of traditional courtroom litigation. ADR techniques include arbitration, mediation, conciliation, negotiation, and facilitation, among others, and they provide parties with a more cost-effective and flexible means of resolving disputes.

Pre-Litigated and Non-Litigated Conflict: Pre-litigated and non-litigated conflicts are disputes and disagreements that have not yet escalated to the formal stage of a lawsuit or legal action. These conflicts can often be resolved through non-adversarial methods such as negotiation, mediation, or other alternative dispute resolution approaches.

Description of Types of Litigation Services

Litigation services encompass various processes for resolving disputes through legal proceedings. Some common types include the following. Click on each tab to explore the definitions.

Arbitration: An adjudicative process where a neutral third party, called an arbitrator, makes a binding decision to resolve a dispute outside of court.

​

Conciliation: A process involving a third party who assists disputing parties in finding common ground and reaching an agreement, but without making a binding decision.

​

Facilitation: A method where a neutral facilitator helps parties communicate and collaborate to address their concerns and reach a resolution.

​

Mediation: A process in which a trained mediator assists disputing parties in finding mutually acceptable solutions to their conflicts.
